1. Introduction

This Privacy Policy describes how cGenie, operated by NeuralAi SpA, collects, uses, stores, and protects personal data when users visit cgenie.ai, use app.cgenie.ai, create campaigns, generate landing pages, or collect leads through cGenie-hosted pages.

2. Data Controller

NeuralAi SpA is the data controller for account and user data. For data submitted by visitors through landing pages generated by cGenie, the cGenie customer is generally the controller and NeuralAi SpA acts as processor or service provider.

3. Data We Collect

Depending on how you use the Service, we may collect:

• Identity and contact data, such as name, email, company, and phone if provided.
• Account data, such as login and authentication data, roles, workspace, and project data.
• Brand and campaign inputs, including business descriptions, websites, keywords, audience, location, services, uploaded brand assets, logos, screenshots, brochures, and brand materials.
• Generated content, including campaigns, ads, keywords, landing pages, forms, and AI outputs.
• Lead and end-user data, such as names, emails, phone numbers, and messages submitted through cGenie landing forms.
• Technical data, such as IP address, browser, device, logs, and usage events.
• Integration data, such as Google OAuth identifiers, Google Ads account IDs, and OAuth tokens if and when you connect Google Ads or other integrations.
• Support communications.
• Billing and subscription data if paid plans are enabled in the future.

4. How We Use Data

We use data to:

• Provide, maintain, and improve the platform.
• Authenticate users and secure accounts.
• Create and maintain Brand Memory.
• Generate campaign structures, ads, keywords, and landing pages.
• Publish landing pages.
• Collect and display leads or prospects to customers.
• Prevent abuse, fraud, and security issues.
• Provide support and send service emails.
• Operate integrations selected by the user.
• Comply with legal obligations.

5. AI Processing

cGenie uses AI model providers and/or AI gateways to generate and edit campaign content and landing pages. Campaign inputs, brand context, and generated content may be sent to AI providers for processing.

Users should not submit sensitive personal data unless necessary. AI-generated outputs may be inaccurate, incomplete, or unsuitable for a particular legal, advertising, or regulatory context. You are responsible for reviewing and approving outputs before use.

6. Legal Bases

We process personal data based on performance of contract, consent, legitimate interests, and legal obligations, depending on the context. Chile’s data protection framework is evolving, including Law No. 21,719, and cGenie aims to align its practices with applicable requirements.

7. Sharing and Subprocessors

We may use service providers for hosting and infrastructure, database and authentication, AI generation, email delivery, analytics and logging, payment processing if enabled, and Google services when you connect Google OAuth or Google Ads.

We do not sell personal data.

8. Customer Landing Page Leads

When a customer publishes a cGenie landing page with a lead form, the customer is responsible for having a lawful basis and privacy notice for collecting visitor information. NeuralAi SpA processes that lead data on behalf of the customer to provide the Service.

9. Data Retention

Account data is generally retained while the account is active. Lead data is retained while the customer account or workspace is active or until deleted. Logs may be retained for security and operations. Backups may be retained for limited periods. Integration tokens are retained while the integration remains connected.

10. Security

We use reasonable technical and organizational safeguards, including access controls, encryption in transit, secure hosting, limited internal access, and backups. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. International Transfers

Data may be processed by service providers outside Chile depending on our infrastructure and AI providers. We use safeguards where required by applicable law.

12. Cookies and Analytics

We may use cookies, local storage, logs, and similar technologies for authentication, security, preferences, analytics, and platform operations.

13. Your Rights

14. Children

The Service is not intended for users under 18 years old.
